By accessing or using the Aphma platform (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Aphma provides an AI-powered trading platform that enables users to create, backtest, and deploy automated trading agents across multiple asset classes. The Service connects to third-party exchanges and executes trades on your behalf based on your configured strategies.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• You must notify us immediately of any unauthorized use of your account.

5. Trading Risks

Trading financial instruments involves substantial risk of loss and is not suitable for all investors. You acknowledge that:

• Past performance of any strategy does not guarantee future results.
• AI-generated strategies may produce losses.
• You are solely responsible for your trading decisions and any resulting gains or losses.
• Market conditions can change rapidly, and automated systems may not respond appropriately to all scenarios.
• You should only trade with funds you can afford to lose.

6. Non-Custodial Nature

Aphma is a non-custodial platform. We do not hold, control, or have access to your funds. Trading is executed through your own exchange accounts via API connections that you configure. We are not responsible for the security or availability of third-party exchanges.

7. Intellectual Property

Strategies you create remain your intellectual property. By publishing a strategy to the marketplace, you grant Aphma a license to display and distribute it to subscribers. You may remove published strategies at any time.

8. Prohibited Activities

• Using the Service for market manipulation or illegal trading activities.
• Attempting to reverse-engineer, decompile, or exploit the platform.
• Creating multiple accounts to circumvent limits or restrictions.
• Publishing misleading or fraudulent strategy performance data.
• Using the Service to launder money or finance illegal activities.

9. Limitation of Liability

To the maximum extent permitted by law, Aphma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising from your use of the Service.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may suspend or terminate the Service for maintenance, updates, or other reasons. We are not liable for any losses resulting from service interruptions.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time. Upon termination, your right to use the Service ceases, and all running agents will be stopped.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
